Commission Tables Subdivision Plat Approval

      The possibility for litigation still looms over Rory Road in Edgewood.
       Rather than trigger a lawsuit, Edgewood’s Planning and Zoning Commission tabled a request to extend preliminary plat approval for Pueblo Artesanos, a 70-acre subdivision that had planned to use the road as an access route.
       The approval, which was granted about a year ago, would have expired if it weren’t addressed at the Monday night commission meeting.
       Development Manager Karen Mahalick said to grant an extension, the applicant has to have suffered unforeseen delays and unusual circumstances.
       “We have experienced unusual delays,” said Mark Jensen, one of the principals on the project being developed by Jensen and Ulrich LLC.
       He mentioned the appeals and changes that have been made to the plans. Jensen said he has also attempted to work with the homeowners who are fighting the development plans.
       “We would like for this whole thing not to have gone on for as long as it has,” he said.
       Near the end of the commission’s discussion about whether to approve the extension, Mahalick mentioned a forthcoming appeal of a prior decision to grant final plat approval for the developer to finish part of the work on the project.
       It’s not the first appeal residents have made over the road.
       By tabling the issue, Mahalick said the commission gave the developers time to work with the homeowners association.
       “That way both parties won’t have to hire attorneys to defend themselves,” she said.
       Peggy Conger, who had been part of previous appeals, said she would not be part of the appeal Mahalick mentioned at the meeting.
       Mahalick asked her how she would characterize her dealings with Jensen and Ulrich so far.
       “I think there’s positive things on both sides,” Conger said. “I can’t speak for the group.”
